1. Agreement to Terms
By accessing and using Orange WS Platform ("the Service"), you agree to
be bound by these Terms of Service ("Terms"). If you disagree with any
part of these terms, you may not access the Service.
2. Description of Service
Orange WS Platform provides communication APIs including:
- WhatsApp Business API messaging
- SMS and RCS messaging
- Number verification services
- SIM swap detection
- Device swap detection
- KYC matching services
- Voice services
- Connectivity solutions
3. User Accounts
3.1 Account Creation
To use our Service, you must:
- Provide accurate and complete information
- Be at least 18 years old
- Have authority to bind your organization (if applicable)
- Maintain the security of your account credentials
3.2 Account Responsibility
You are responsible for:
- All activities under your account
- Maintaining accurate account information
- Immediately notifying us of unauthorized access
- Compliance with all applicable laws and regulations
4. Acceptable Use
4.1 Permitted Uses
You may use our Service for legitimate business communications including:
- Customer notifications and alerts
- Marketing communications (with proper consent)
- Two-factor authentication
- Transactional messages
- Customer support communications
4.2 Prohibited Uses
You may not use our Service for:
- Spam or unsolicited communications
- Illegal activities or content
- Harassment, threats, or abusive content
- Phishing or fraudulent activities
- Sharing malware or malicious content
- Violating third-party rights
- Circumventing platform restrictions
5. Billing and Payment
5.1 Pricing
Current pricing is available on our platform. Prices may change with 30
days notice.
5.2 Payment Terms
- Prepaid model: Add funds to your account balance
- Charges are deducted from your balance in real-time
- All prices are in EUR unless otherwise stated
- Refunds are subject to our refund policy
5.3 Taxes
You are responsible for any applicable taxes, duties, or fees related to
your use of the Service.
6. Service Availability
6.1 Uptime
We strive to maintain high availability but do not guarantee uninterrupted
service. Planned maintenance will be announced in advance when possible.
6.2 Third-Party Dependencies
Our Service depends on third-party providers (WhatsApp, Orange, etc.).
Service interruptions may occur due to third-party issues beyond our
control.
7. Data and Privacy
7.1 Data Processing
We process your data according to our Privacy Policy. By using the
Service, you consent to such processing.
7.2 Data Security
We implement industry-standard security measures, but you acknowledge that
no system is completely secure.
7.3 Data Retention
We retain data as described in our Privacy Policy and as required by law.
8. Intellectual Property
8.1 Our Rights
The Service and its content are protected by copyright, trademark, and
other intellectual property laws.
8.2 Your Content
You retain ownership of content you submit but grant us necessary rights
to provide the Service.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We provide the Service "as is" without warranties

10. Indemnification
You agree to indemnify and hold us harmless from claims arising from:

11. Termination
11.1 By You
You may terminate your account at any time by contacting us.
11.2 By Us
We may suspend or terminate your account for:
- Violation of these Terms
- Non-payment of fees
- Fraudulent or illegal activity
- Extended inactivity
11.3 Effect of Termination
Upon termination:
- Your access to the Service will cease
- Unused account balance may be refunded (subject to our policies)
- We may delete your data according to our retention policy
12. Changes to Terms
We may modify these Terms at any time. Material changes will be
communicated via email or platform notice. Continued use constitutes
acceptance of modified Terms.
13. Governing Law
These Terms are governed by Spanish law. Disputes will be resolved in
Spanish courts, except where EU consumer protection laws apply.

15. Severability
If any provision of these Terms is found unenforceable, the remaining
provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire
agreement between you and Orange WS Platform regarding the Service.
17. Radar Module — Meta Advertising Services
If you use the Radar module to run advertising campaigns on Meta
platforms (Facebook, Instagram, WhatsApp) through the Service, the
following additional terms apply.
17.1 Role of the Parties
- You operate advertising campaigns on your own Meta Business Manager, Ad Account and Pages, connected to the Service through OAuth (Facebook Login for Business)
- Meta bills you directly for all advertising spend. MASBUSINESS does not act as an advertising agency and does not intermediate payments for ad spend
- You retain full control over, and responsibility for, all campaigns, creatives, targeting and spend
17.2 Client Responsibilities
- Comply with Meta's Advertising Policies, Community Standards and WhatsApp Business Policy
- Ensure all content, targeting and landing experiences comply with applicable law (including consumer protection, data protection and advertising regulations)
- Obtain all necessary end-user consents for advertising cookies and tracking technologies
- Maintain a valid payment method on your Meta account
- Declare, where applicable, Special Ad Categories (Credit, Employment, Housing, Social Issues, Politics, Health)
17.3 No Warranty of Approval or Performance
We do not guarantee that your ads will be approved by Meta, that they
will reach any particular audience, or that they will produce any
particular business outcome. Meta retains sole discretion over ad
approval, delivery and enforcement. Ad rejections, account-level
strikes, audience restrictions or temporary limits imposed by Meta on
your Business Manager or Ad Account are your sole responsibility.
17.4 Limitation of Liability Specific to Radar
In addition to Section 9, we are not liable for:
- Advertising spend charged by Meta to your payment method
- Ad rejections, strikes, account disablements or quality-rating changes imposed by Meta
- Changes in Meta's APIs, policies or pricing that affect campaign delivery
- Business outcomes (sales, bookings, leads) attributed or not attributed to campaigns
